1. Acceptance of Terms
By accessing or using the suite of services provided by Apex Systems ("the Company"), including our AI-driven communication tools, CRM platform, and automation workflows, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you (the "Client") and Apex Systems. If you are entering into this agreement on behalf of a business entity, you represent that you have the legal authority to bind that entity to these terms.
2. Description of Services
Apex Systems provides a comprehensive business management and automation platform. Our core services include, but are not limited to, AI-powered phone reception, automated appointment scheduling, lead management, and Proprietary CRM access. These services are designed to optimize business efficiency and customer engagement. We reserve the right to enhance, modify, or update these services to maintain industry-leading standards.
3. SMS Messaging & Communication Protocol
As part of the Apex Systems Appointment Notifications program, users may receive automated text messages regarding appointment confirmations, schedule changes, and essential service-related reminders.
Message Frequency: The number of messages sent will vary based on the specific appointment activity and interaction level of the user.
Carrier Charges: Standard message and data rates may apply according to your specific mobile carrier plan.
Support & Opt-Out: For assistance, users may reply HELP to any message or contact our support team at Support@apexsys.org. To cease receiving SMS communications, users may reply STOP at any time. Upon receipt of a STOP request, the system will send one final confirmation message to verify the opt-out status.
Carrier Compatibility: Our SMS services are supported by all major U.S. carriers, including but not limited to AT&T, Verizon, and T-Mobile.
4. Payment Terms & Financial Obligations
All services provided by Apex Systems are billed on a recurring monthly basis. Invoices are issued and payment is due on the 1st day of each month. To ensure uninterrupted service for your business, accounts must remain in good standing. Apex Systems reserves the right to suspend or terminate service access in the event of late or non-payment. All setup fees, where applicable, are non-refundable as they cover the initial configuration of the AI and CRM environment.
5. Cancellation & Termination
We believe in the value of our partnerships; however, should you wish to discontinue services, Apex Systems requires 30 days' written notice via email to Support@apexsys.org. During this notice period, all services will remain active, and the Client remains responsible for the final month’s service fees.
6. Limitation of Liability & Indemnification
Apex Systems provides its platform and AI services on an "as-is" basis. While we strive for 100% uptime and accuracy, the Company shall not be held liable for any indirect, incidental, or consequential damages—including loss of revenue or data—arising from the use or inability to use our services. The Client agrees to indemnify and hold Apex Systems harmless from any claims resulting from the Client's specific use of the automated tools.
7. Modifications to Terms
Apex Systems reserves the right to modify these Terms and Conditions at any time to reflect changes in technology, legal requirements, or company policy. We will notify clients of significant changes via the email address provided on the account. Continued use of the Apex Systems platform following any such modifications constitutes your formal acceptance of the revised terms.
